This course examines the laws governing interactions between human activities and the environment. These include the laws governing the air, water, toxic chemicals, hazardous waste, resource use, biodiversity and ecosystems, and climate change. The course focuses on the U.S. legal system, with some comparative analysis of the law in other countries and international regimes. The course assesses key features of these environmental laws, including the rationales for environmental protection (e.g. ethical, economic); the choice of regulatory policy instruments (e.g. standards, taxes, trading, information disclosure); and the roles of different levels of government (e.g. local, state, national, international), branches of government (e.g. legislative, executive/administrative, judicial), and non-governmental actors.
We will study how these laws handle key questions such as (i) How serious a problem is it? (ii) How much protection is desirable, overall regarding distributional impacts? (iii) How best to achieve this protection? (iv) Who decides and acts upon these questions? The course helps develop critical skills including statutory and regulatory interpretation, regulatory design, policy analysis, case law analysis, and litigation strategy.

Environmental Law practice is relatively new. Since the 1970s, hundreds of thousands of pages of regulations have been passed by the Environmental Protection Agency (EPA) and other federal, state, and local agencies. With so many regulations being passed, a wide variety of environmental issues such as the disposal of hazardous waste, the transfer or sale of property that may be contaminated, and land protection are being resolved by environmental lawyers.
Many environmental lawyers help guide businesses through the complicated process of obtaining the necessary permits and licenses from regulatory agencies to build or transfer industrial property while taking into consideration federal, state, and local environmental laws. Others work in government or non-profits and focus on enforcing current laws and advocating for new ones.

Energy and Environmental Law Certificate
JD students have the opportunity to pursue a Certificate in Energy and Environmental Law by creating an individualized curriculum of energy and environmental course work, as well as one of the following: an advanced writing project, a clinic, or an externship with an appropriate law firm, energy company, utility, regulatory or quasi-public agency, or public interest organization. Through the certificate program, students develop substantive knowledge in energy and environmental law while strengthening their analytical, lawyering, legal research, and writing skills.
Learning Outcomes
Upon successful completion of the JD Certificate in Energy & Environmental Law, students will be able to:
- Explain and apply core legal principles and policy considerations relevant to the practice of energy and environmental law.
- Interpret and research federal, state, public utility, and local laws and regulations governing energy and environmental law practice.
- Perform essential lawyering skills such as document drafting, collaboration, negotiation, and advising clients in energy and environmental law settings.
- Analyze and solve complex legal problems involving cutting-edge issues such as climate change law, renewable energy law, international environmental law, and environmental torts.
Requirements
Twelve (12) credits are required to complete the certificate. There is one required course: Administrative Law.
Sustained Project (3 credits)
including any one of the following:
- A writing project that produces a substantial paper of an intensive, analytical character that is of high quality that is supervised by a member of the energy or environmental law faculty. If there are multiple drafts, this paper may also be used to satisfy the Upper-Class Writing Requirement;
- Participation in the Environmental Law Clinic the Energy and Environmental Law Practice Clinic; or
- An externship or externship clinic in energy or environmental law with a significant writing requirement.

Florida State University College of Law in Tallahassee offers a terrific place to study environmental, energy, and land use law. The Center for Environmental, Energy, and Land Use Law Certificate Program is designed to allow students to complete the requirements while simultaneously completing a well-rounded non-certificate curriculum as well. 12. Boston College Law School
The BC Law Land & Environmental Law Program is designed to train professionals and encourage service in areas of increasingly critical importance to the lives and prosperity of people around the nation and the world, promoting policies and doctrines of sustainability of land, air, and water resources that support the myriad interlocking ecosystems that constitute life on the planet.
Students’ contact with the program typically begins with the Environmental Law Society (ELS) welcoming barbecue reception in September of the first year and ends in the third year with the opportunity for a special project, such as teaching the environmental law course in the University’s College of Arts & Sciences, participating in the National Environmental Moot Court competition or other public interest projects, or—by adding two semesters—a dual degree program awarding a Boston College JD and one of several different masters degrees in conjunction with Tufts University’s graduate schools or Vermont Law School. A certificate in Land & Environmental Law is awarded by ELS at graduation to students who have completed the required credits and a project in the field.

Founded in 1994 in consultation with community leaders, the Environmental Law and Justice Clinic serves as a training ground for the next generation of social justice advocates and provides critical legal services to underserved communities in the San Francisco Bay Area and beyond.
